When legal action is required, how can Creditfax help?

Many times, a debtor flatly refuses to pay the client or the Debt Recovery Agency. When this happens, we will evaluate the merits of possible legal action. Investigating the available assets, the costs to litigate, the amount in question and the client’s requirements are all considered.

Creditfax does not employ lawyers or paralegals and does not provide legal advice. Should you require legal advice, we can then connect you with a lawyer or paralegal in our Attorney Network for a consultation. To create a single point of contact, once you decide to pursue a claim in either Superior Court or Small Claims, our Legal Forwarding Department will be responsible for communicating with the paralegal or attorney to provide regular updates to you. While we consider litigation to be a very valuable tool, we also see it as a last resort in your claim and will pursue all other alternative avenues of debt recovery before assessing the viability of you taking a legal action against your customer.

Along with our in-house debt collectors that provide you with years of working experience in professional debt recovery, we have established a specialized Attorney Network in North America. Their job is to assist us with a more localized debt recovery of your difficult accounts in your debtor’s jurisdiction. With their help, we can reach out and affect your debtors wherever they may be. When negotiation is not possible, they are able to litigate and execute the claim for you. Not only do the attorneys or paralegals litigate your account, but they execute the judgment afterward. They are extremely aggressive in their approach and help bring the legal ramifications of non-payment to bear against your customer.

All Small Claims actions can be handled by you as the plaintiff and/or with lawyers or paralegals as required by jurisdiction. Suit filings in the Superior Court are referred to our Attorney Network for further action.
